By signing this Waiver, I acknowledge that I am participating, or I am the parent/legal guardian of a minor participating, in a clinic, camp, lesson, or other program offered by Taylored Pickleball Academy ("TPA") at 11 Sports & Social Club ("the Club").

​

1. TPA Program Administration and Responsibility

​

I acknowledge and understand that all clinics, camps, lessons, and other programs offered by TPA at the Club are organized, administered, operated, and delivered solely by TPA.

​

The Club provides court and facility rental space to TPA only and is not responsible for the administration, instruction, coaching, registration, scheduling, program content, participant supervision, pricing, refunds, cancellations, or other operational aspects of TPA's clinics, camps, lessons, or programs.

​

TPA is responsible for the actions and conduct of its coaches, instructors, employees, volunteers, and representatives in connection with its programs.

​

Any questions, concerns, complaints, disputes, refund requests, or other issues relating to a TPA clinic, camp, lesson, or program must be directed to and resolved directly with TPA.

​

I acknowledge that my participation, or my child's participation, in a TPA program does not create a contractual relationship between me and the Club with respect to the delivery or administration of that program.

​

2. Acknowledgement and Assumption of Risk

​

I understand that participation in pickleball, sports instruction, camps, clinics, and related physical activities involves inherent risks.

​

These risks may include, but are not limited to: slips, trips, and falls; running and sudden changes in direction; collisions with other participants, instructors, walls, nets, or other objects; being struck by pickleballs, paddles, or other equipment; muscle strains, sprains, fractures, joint injuries, and other physical injuries; overexertion, fatigue, dehydration, or physical distress; injuries arising during drills, games, exercises, coaching, or instructional activities; and other risks ordinarily associated with participation in pickleball and physical activity.

I voluntarily accept and assume the risks associated with participation in these activities and use of the facility.

​

I am responsible for participating within my own abilities and for informing the appropriate TPA instructor of any limitation that may affect my ability to safely participate.

​

3. Release of Liability

​

To the fullest extent permitted by law, I voluntarily assume responsibility for the risks associated with my participation in pickleball and related activities and release and forever discharge 11 Sports & Social Club, its owners, officers, employees, contractors, volunteers, and representatives from claims for loss, injury, damage, or expense arising from my participation in activities or use of the Club's facility, except where such release is prohibited by law.

I agree to be responsible for any loss or damage to Club property caused by me or by a minor participant for whom I am legally responsible.

​

TPA is the provider of the clinic, camp, lesson, or program. Any release, waiver, or indemnification required by TPA with respect to TPA, its coaches, instructors, employees, volunteers, or representatives is the responsibility of TPA and should be reviewed and approved by TPA and its insurer or legal counsel.

4. Personal Insurance and Accidents

​

I understand that the Club does not provide accident, medical, dental, disability, or personal property insurance for participants in TPA programming.

​

Participants are encouraged to maintain adequate personal health and accident insurance to cover potential injuries and medical expenses associated with participation.

​

In the event of an injury or medical emergency, emergency medical assistance may be requested or arranged by the Club or TPA where reasonably necessary. Any costs associated with medical treatment, ambulance transportation, or other emergency services are the responsibility of the participant or, where applicable, the participant's parent or legal guardian.

5. Health, Fitness and Medical Readiness

​

I am responsible for ensuring that I am physically capable of safely participating in pickleball and the activities included in the TPA program.

​

The Club and its staff are not responsible for determining whether a participant is medically or physically capable of participating in a TPA program.

​

By participating, I represent that I am not aware of any medical condition, injury, or physical limitation that would make participation unsafe for myself or others, or that I have obtained appropriate medical advice regarding participation.

​

Participants should immediately report injuries or health concerns to the TPA instructor conducting the program and, where appropriate, Club staff. Participants are encouraged to consult a physician or other qualified healthcare professional before beginning or resuming strenuous physical activity where appropriate.

​

6. Participant Registration and Club Waiver Requirement

​

All participants in TPA clinics, camps, lessons, and programs conducted at the Club must have a participant account with 11 Sports & Social Club and complete all required Club registration and waiver requirements before entering the court area.

​

The Club reserves the right to deny court access to any participant who has not completed the required registration or waiver process.

​

7. Personal Property and Vehicles

​

Participants and guests are responsible for the security of their personal belongings, including items left in change rooms, lounge areas, court areas, or elsewhere on the premises.

​

The Club is not responsible for loss, theft, or damage to personal property brought onto the premises, including cash, phones, jewelry, clothing, sports equipment, or other belongings.

​

Vehicles parked on Club property or surrounding parking areas are parked at the owner's risk. Participants and guests are responsible for securing their vehicles and valuables.

​

8. Code of Conduct

​

All participants and guests are expected to maintain a culture of sportsmanship, inclusivity, safety, and respect while at the Club.

​

Participants and guests must: treat players, coaches, Club staff, spectators, and other guests courteously; refrain from harassment, discrimination, threatening behaviour, or aggressive conduct; refrain from inappropriate profanity, aggressive yelling, or arguing; follow all posted safety signage and reasonable instructions from Club staff; wear clean, appropriate indoor athletic footwear and attire; respect court schedules and time limits; use appropriate pickleball etiquette; keep food and beverages off the courts, except water in closed containers; and dispose of waste appropriately and assist in maintaining a clean facility.

The Club reserves the right to remove an individual from the premises where their conduct is unsafe, disruptive, inappropriate, or contrary to Club policies.

​

9. Smoke-Free Facility

​

In accordance with applicable Ontario law and Club policy, smoking, vaping, and the use of tobacco, cannabis, or similar products are prohibited in areas where such activity is prohibited by law and within designated smoke-free areas of the Club property.

​

All participants and guests are required to comply with posted signage and Club policies relating to smoking and vaping.

​

10. Scent-Free Environment

​

11 Sports & Social Club is a scent-free facility.

​

Participants and guests are asked to arrive free of strong scents or fragrances and to refrain from using perfumes, colognes, scented sprays, or other strongly fragranced personal products while at the Club.

​

The Club reserves the right to remind individuals of this policy or ask an individual to leave and return fragrance-free where necessary.

​

11. Vehicle Conduct and Parking

​

Participants and guests are expected to operate vehicles safely, responsibly, and courteously while on Club property.

​

Vehicles must be parked within designated parking spaces and must not obstruct access lanes, entrances, exits, fire routes, pedestrian areas, or other vehicles.

​

Unsafe, aggressive, or inappropriate driving or repeated parking violations may result in the individual being asked to leave the property or being restricted from future access to the Club.

Acknowledgement

​

By signing or electronically accepting this Waiver, I confirm that: I have read and understood this Waiver; I understand the risks associated with participation in pickleball and TPA programming; I understand that TPA is responsible for administering and delivering the program; I understand that 11 Sports & Social Club is providing the facility and court space to TPA; I agree to comply with the Club's facility rules and policies; and I voluntarily agree to the terms of this Waiver.
